General Terms and Conditions

Welcome to Atlas Digital AB (“Atlas Digital”, “we”, “our”, “us”).
These General Terms apply to all orders and services performed through atlasdigital.se and related subdomains.
By ordering or using our services, you (“the Customer”, “you”) agree to these terms.

For subscription-based website plans, please also read our Subscription Terms which apply in addition to these General Terms.

1. General Information

Atlas Digital AB is registered in Sweden under organization number 559567-7286.
Registered seat: Göteborg, Västra Götaland.
All services and content on this website are owned by Atlas Digital AB.
All prices are listed in Swedish kronor (SEK).
Consumer prices include VAT; business prices exclude VAT.

Atlas Digital reserves the right to correct errors, adjust pricing, or update service details without prior notice.
Illustrations and design previews are examples only and may differ from the final result.

2. Eligibility

To order from Atlas Digital, you must be at least 18 years old.
Orders made by minors require written consent from a legal guardian, including name and phone number.

Atlas Digital reserves the right to decline or modify an order if incorrect or incomplete information is provided.

3. Data and Privacy

We process personal data in accordance with the General Data Protection Regulation (GDPR) (EU Regulation 2016/679).
Customer data is stored only for operational and billing purposes (e.g., domain management, hosting setup, and communication).

Your contact details, such as name, address, phone number, and email, must be accurate.
Data will never be shared with third parties except when required by law.
Email correspondence may be archived for quality and documentation purposes.

If you wish to request or delete your personal data, contact us at info@atlasdigital.se.
Deletion requests will be granted as long as they do not conflict with Swedish accounting and tax legislation.

4. Consumer Protection

For consumers, we follow:

Konsumentköplagen (SFS 1990:932)
Distansavtalslagen (SFS 2005:59)
GDPR (EU 2016/679)

For business clients, the Swedish Purchase Act (Köplagen) applies.

5. Right of Withdrawal (Ångerrätt)

Private consumers have a 14-day withdrawal right under Swedish distance sales law.
However, this right no longer applies once work has begun on your website or hosting setup.

If cancellation occurs after project work has started, Atlas Digital may charge a reasonable fee of 50% of the total project cost plus any third-party expenses (domains, SSL certificates, plugins, etc.).

Business-to-business (B2B) orders are not subject to the consumer withdrawal right.

6. Intellectual Property

All graphics, designs, text, templates, and code provided by Atlas Digital are protected by copyright.
They may not be copied, resold, or redistributed without written permission.
Images used on client websites may be licensed stock assets or original works created by Atlas Digital designers.

Client-provided content (text, images, logos) must be free from third-party copyright restrictions.
The client bears full responsibility for uploaded or submitted materials.

7. Design, Text, and Delivery Process

All projects are created uniquely according to the customer’s needs and the selected package.

To ensure timely delivery:

Customers must provide all texts, images, and relevant materials before project start.
Changes or feedback must be delivered in a single, structured document (e.g., Word, Google Docs, or clearly annotated screenshots).
Small or fragmented change requests sent across multiple emails may delay the process and incur additional fees.

If the client fails to deliver complete materials within one month of order confirmation, Atlas Digital may close the project and invoice the agreed price for work completed to date.

8. Pricing and Payment

All prices are shown in SEK.
Consumer prices include VAT; business prices exclude VAT.
Payment is due according to the invoice terms.

Payment terms may vary by service type.
For subscriptions, see available billing cycles and accepted payment methods in the Subscription Terms.

Invoices are sent electronically. Unpaid invoices accrue statutory interest and may be transferred to collection (Inkasso).
Failure to pay may result in suspension of website hosting or service access.

For larger projects (over 5,000 SEK), a start fee of 50% or 2,500 SEK (whichever is higher) applies, with the remainder due upon completion.

9. Hosting and Domain Policy

Hosting is included in all active services provided by Atlas Digital.
Only domain renewals after the first 12 months may incur additional annual fees.

Atlas Digital hosts websites through professional providers such as Cloudflare to ensure high uptime and performance.

10. Ownership and Licensing

Upon full payment, the client gains ownership of the delivered website content and design files.
Templates, frameworks, and licensed components remain the intellectual property of Atlas Digital unless otherwise agreed.
For additional features or integrations, work is billed hourly as described in the Subscription Terms.

11. Limitation of Liability

Atlas Digital cannot be held responsible for:

Third-party plugin or software errors
Downtime caused by external hosting, DNS, or force majeure events
Losses resulting from client-side edits, deletions, or misconfigurations

In no event shall Atlas Digital’s liability exceed the total fee paid by the customer for the relevant service.

12. Force Majeure

Atlas Digital shall not be liable for failure or delay in performance due to causes beyond its control, including but not limited to:
power outages, internet failure, natural disasters, war, pandemics, or major third-party system failures.

13. Disputes and Governing Law

Atlas Digital follows the recommendations of Allmänna Reklamationsnämnden (ARN) and applicable Swedish law.
In case of dispute, Swedish courts shall have jurisdiction, with Gothenburg District Court (Göteborgs Tingsrätt) as first instance.

14. Changes to These Terms

Atlas Digital reserves the right to amend these terms at any time.
Updated versions will always be published on this website.
The latest version applies from the date of posting.
